Why is Queens a Non-Countable Tournament?

GasquetGoAT, Andy Murray received a penalty for dropping out of Indianapolis too late last year or something. Therefore he'll be able to count Queens only AFTER his '0 points penalty' of indianapolis expires in a few weeks.

Rafa drops 2250 between now and 17th August.

Murray drops 1450 points in the same period.

If Murray picks up 210 points more than Rafa @ Canada/Cincy then he will overtake Rafa in the rankings before the start of the USO.

Which will be quite interesting, because then Nadal and Federer will be in the same half of the draw.
