Any word on Kirby? Did you contact admin of this site already? Did you send email to his school?
i wanted to give him a chance to have this resolved, so decided to give him a couple of days but he's so far gone cold again.

You are very patient person.
I would take action by now.
You have all the info man. It is up to you what to do.
I would at least get him out of this site so he does not rub other people.

All,

Thanks to all who have given advice and helped with the matter, just wanted to let all of you know that it took a while but Kirby honored his word and paid a fair replacement cost of the racket plus the cost of my racket shipping cost.

Note to myself - do the necessary homework next time and check references...

Glad to hear that everything worked out for you.
Yes, be more careful next time.
Good luck.

Thanks guys without the assistance of the TT board I doubt I'd be any closer to a resolution that when I'd started. It's the good community here that makes the system work.

I can only hope kirbster learns from this experience as well.

Hey guys, I know this thread has been dead for awhile, but I'm currently dealing with another guy named "Kirby mendes" under username "elahn.pogue"

He is from boca raton, fl. I'm just wondering if anyone has any info of a possible connection and I do hope they are not the same person.

Last we heard, Kirby still resides outside Toronto in daddy's house and is/was attending college a a smallish private college in PA.

I would be very careful of anyone named Kirby Mendes. Good chance it is the same kid.

EDIT: After a little digging, 99.99999999999999999999% chance it is our old fiend Kirby. He apparently is no longer at St Francis U but coincidentally he had a teammate at St Francis named, wait for it, Elahn Pogue.

DON'T DO THE DEAL !!!!!!!!!!!

EDIT2: It is Kirby. He is in Boca all right. Now attends Florida Atlantic. Probably got booted from St Francis.

PFChang please post the email he is using now. elahn.pogue@hotmail.com ?

Yeah that is it. I have to say I was a bit suspicious. He was a bit lacking in communication and on the day he was supposed to ship. I emailed him awhile back today saying that I'd like to work with him (before I knew he was this Kirby) but I have yet to hear from him. I guess I'll see what he says and go from there. It's kinda sad but I could use the racket he was gonna trade me lol

Under no circumstances do a trade with Kirby.

And if you do, don't come crying to me when he rips you off.

The only reason the OP in this thread got his money back was because I gave him Kirby's dad's email address so Kirby knew if he didn't refund the OP, there would be hell to pay with Daddio.

Nah obviously not going to, just curious as to what he says or if he even reponds at all.

But kirbster123 - agreed to a trade with me.

http://tt.tennis-warehouse.com/showthread.php?t=259105

for a N61 16x18 - 4 3/8 racket.

He confirmed the trade on 10th of May. I sent the racket out on the 11th of May with a scanned copy of the receipt sent.

http://dl.getdropbox.com/u/387530/receipt.pdf

I followed him up on the 13th of May just confirming he's sent the racket, I waited three days for a reply and again I followed him up on the 16th.

He was ultra responsive when communicating about what my racket was like - response time was within hours. But ever since my racket was sent I have not had a single reply.

Now I like to give people the benefit of the doubt maybe he's been away but the fact is he has been active on these forums, in my mind is either I am missing something or something is seriously wrong....

He never did. Did you read the thread?

Kirby told him he shipped it (without tracking) but that the Canadian PO later called him and told him they had lost the package.

Then Kirby told him he shipped a replacement to make up for the first "lost" racket. That one was also "lost."

Anthony the Aussie (a very nice man) finally got a refund, but only after I gave him Kirby's dad's email address and phone number and Anthony threatened to contact his dad. When Kirby knew daddy was about to get involved, he issued a payment for the racket he received in the unfulfilled trade.

He then came back to rip off a few other guys here and I finally said "enough" and emailed his dad. Suddenly, everyone received refunds and apologies. Funny how that works.

He also did stuff like post phoney references for himself. And he once charged a guy extra for shipping to Canada even though he lives in Canada. He even went so far as to create a phony USPS tracking number. A real piece of work that one.

This kid (21?) is a serial liar and about half a dozen people here had bad experiences with him under his various user names. I have no doubt he is here under some other name so if you are dealing with someone with a Markham, Ontario or Boca Raton, FL address be extra careful.

I have noticed that scamming seemed to be way down this year. I think people are being a little smarter in their dealings and the would-be scammers see what happens to other scammers here and figure it isn't worth the grief. There were a couple of incidents where someone got ripped off (that whole Johnny5 thing for one) but for the most part, it seems that things were better this year.
