Is the shoe in the first pic by the OP a manufacture defect or is it standard?

I think Niketown did Joel a favor and replace them as "defective" but I doubt either Nike or Tennis Warehouse would replace them under the six month warranty as they're not burned through to the midsole.

Niketown is a very nice little store.
Always willing to take back anything worn if you don't like it. In my case the shoes didn't hit the midsole, and those first pics were not the point I returned them. I returned them because they were scary to play on clay with.

The only thing scarier than bald 3.3's on clay were the bald flat soled 2.3's: wow, they were just useless on clay. I got my green 3.3's in today....right after I got back from playing. I went down a half size back to a 9.5 from a 10. I like the slightly snugger fit. The 10's were just too roomy but they were still the GSOAT's. I did my return through TW and they were 3 thumbs up. Really quick on the turnaround: I mailed them Thursday, one week ago and got them today: that includes Friday's no shipping day as well. Thanks TW.

so my black and white 3.3s have multiple spots that are through the first layer of rubber and I'm on the second layer of black rubber. Do you think I need to burn through one more layer to get the warranty? This is my first pair of shoes that I can actually use a warranty for so I need all the advice I can get.

I would advise you to go through to the midsole otherwise nike will reject them and you will also be out $10 for shipping
