Terms and Rules

Thank you for visiting Tennis Warehouse’s (“Tennis Warehouse”,”We”, “Us” or “Company”) Talk Tennis Message Board (“Message Board”). Here are a few things you should know about our Message Board policy (“Policy”) and how to remain in good standing as a participant. Our goal is to create a welcoming, respectful, and safe environment where we can all discuss our favorite topic: tennis!

Participation in the Message Board is free and voluntary, however is strictly subject to the below terms and conditions in conjunction with the Tennis Warehouse Terms of Use located at https://www.tennis-warehouse.com/termsofuse.html.

Violation of these terms may result in removal of Posted Content (as defined below) and/or suspension or banning of the author. We reserve the right, in our sole discretion, to determine whether a user has violated the Policy and the resulting enforcement action.

EXCEPT TO THE EXTENT PROHIBITED BY LAW, YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD TENNIS WAREHOUSE, ITS AFFILIATES, AND THEIR RESPECTIVE, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, THIRD-PARTY SERVICE PROVIDERS, AND LICENSORS (THE “AFFILIATED ENTITIES”) HARMLESS FROM AND AGAINST ANY CLAIM OR DEMAND MADE BY ANY THIRD PARTY, AND ANY RELATED LIABILITY, DAMAGE, LOSS, AND EXPENSE (INCLUDING COSTS AND ATTORNEYS’ FEES) DUE TO, ARISING OUT OF, OR IN CONNECTION WITH: (A) YOUR USE OF THE TENNIS WAREHOUSE WEBSITE; (B) YOUR VIOLATION OF THIS POLICY; (C) YOUR VIOLATION OF APPLICABLE LAWS OR REGULATIONS; OR (D) YOUR POSTED CONTENT. WE RESERVE THE RIGHT TO CONTROL THE DEFENSE OF ANY MATTER FOR WHICH YOU ARE REQUIRED TO INDEMNIFY US, AND YOU AGREE TO COOPERATE WITH OUR DEFENSE OF THESE CLAIMS.

Rules of Behavior

1. You are solely responsible for your own communications including but not limited to any text, data, images, graphics, audio, video, email, links, and/or screen names (collectively, “Posted Content”) you post to the Message Board. You agree that the Posted Content is considered to be public information, is non-confidential, legal and proper for this forum.
2. We allow only one username per person. If you have additional usernames, it can be grounds for banning. Additionally, we do not allow username to have religious or political themes. Usernames that are impersonating a real person/player are not allowed (example: Roger Federer). Username such as Fed0622 would be allowed. Similarly, no religious, political or inappropriate avatars will be allowed. Avatars that feature players that have been edited are also not allowed. Stealing avatars to troll or pretend to be another user is not allowed.
3. You must not abuse, defame, harass, stalk, threaten, intimidate, or otherwise violate the legal rights of other users and participants of the Message Board. Harassing another user through the private messaging system is also not permitted.
4. You must not violate the privacy or publicity rights of others, including posting any private photos or links to private or confidential content.
5. You must not upload, post or link to any material that is inappropriate, defamatory, infringing, obscene, vulgar, libelous, racially or ethnically hateful, objectionable, or unlawful (or promote or provide instructional information about illegal activities or communications that could reasonably cause damage, loss, harm, or injury to any individual or group).
6. You must not post, upload or link to (a) anything that promotes or distributes pyramid schemes or chain letters, or (b) other disruptive, illegal or immoral communications of any kind.
7. You must not post, upload or link to anything that could potentially exploit or harm children by exposing them to inappropriate Posted Content, asking for personally identifiable details or information, or otherwise exposing them to materials or information which in any way could cause damage, injury, or harm of any kind.
8. You must not post, upload or link to anything that harvests or otherwise collects information about other users, including without limitation addresses, phone numbers, e-mail addresses, and/or health or financial information of any kind, without the users’ prior express consent in each instance.
9. You must not post, upload or link to anything that advertises any commercial endeavor (e.g., offering for sale any products or services) or otherwise engages in any commercial activity (e.g., conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services), or solicits funds, advertisers or sponsors for any purpose. No self-promotion is allowed. This includes products, services or otherwise (whether or not for profit), or solicit others or use any forum for commercial purposes of any kind. Links to social media sites including Youtube, Facebook, Instagram, TikTok, etc as well as user’s own articles, blogs, websites, videos (see below), etc in order to solicit funds or promote commercial services are not allowed without the express consent of Tennis Warehouse. Whether or not your page is for profit, it is a standard that we apply to everyone because if we allow one-person, other people will want to follow suit. We would like to keep the Message Board from becoming full of advertisements.
   
   Youtube accounts- Users are allowed to post Youtube videos of non-commercial tennis activities. However, when an account has a specific name with a brand, logo, sponsors, ads that is where the restrictions apply. Additionally, videos that have sponsored ads or discount codes, promotions are not allowed (as opposed to embedded Google ads). We consider this a business and posting videos is a form of self-promotion and not allowed.

10. Where buying and selling is permitted, it must happen only in a designated forum approved and moderated by Tennis Warehouse.
11. If you would like an official account for your company, please contact the admin for approval.
12. To report a post, you may do so only if you believe a post is breaking one of the policies above, however you may not abuse the report feature on the Message Board. You can also report if you would like one of your own posts updated or removed.
13. With certain exceptions such as equipment-related reviews, you must not upload or post anything that infringes any patent, trademark, copyright, trade secret or other intellectual property or other legal right of a third party without prior written permission from the third party in each instance, which written permission you agree to disclose to us at any time on our request (subject to all applicable laws). You must not intentionally download any material that you know or should reasonably know cannot be distributed legally. if you would like to report any potential copyright infringement, please refer to the ‘DMCA Notice’ instructions in the main website Terms of Use here https://www.tennis-warehouse.com/termsofuse.html
14. You must not impersonate another person, group of people, or entity at any time, including, but not limited to, a Tennis Warehouse official, Message Board leader (moderator), guide or host, which includes not using anyone else's username or password, or falsely state or otherwise misrepresent your affiliation with a person or entity.
15. You must not (a) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Posted Content transmitted through the Message Board; (b) interfere with or disrupt the Message Board, computer servers or boards accessible through the Message Board; (c) interfere with or disrupt the Message Board, computer servers or boards accessible through the Message Board; or (d) disseminate off-topic messages on boards promoting any product, Message Board, web site, board or venture, or promote boards on the Message Board through unsolicited electronic mail messages to third parties.
16. You must abide by all applicable Federal, State and local laws. If you are outside the United States, you must comply with all local laws as well with respect to your online conduct and acceptable Posted Content including without limitation the exportation of data to the United States or to your country or residence.
17. You cannot modify, edit, or delete any Posted Content and communications of the Tennis Warehouse site and/or of other individuals other than your own Posted Content.
18. Playtests, giveaways, contests, surveys must be approved by the admin before posting.
19. You must not transmit any viruses, worms, defects, Trojan Horses or any items and/or computer code, files or programs of a destructive nature and/or otherwise designed to interrupt or limit the functionality of any computer software or hardware or telecommunications device.
20. You must not do anything that disrupts the normal flow of dialogue, causes a screen to scroll faster than other users are able to type, or otherwise act in a way which affects the ability of other people to engage in real-time activities through this website.
21. You cannot create member accounts under any false or fraudulent pretenses (including by automated means).
22. You must not state or imply that any of your submitted and or Posted Content is endorsed by Tennis Warehouse or any affiliate thereof.
23. You must not retrieve, store or collect personal information about any user for any unauthorized purpose, and may not retrieve, store, or collect personal information about any user for any valid purpose without such user’s prior written consent in each instance (and acknowledgment that they are at least 13 years of age).
24. You must not engage in any "spamming" of any kind, including without limitation ad spamming.
25. You cannot use the Tennis Warehouse name or trademarks or related trade names, which you acknowledge here to be valid, subsisting and enforceable without impediment, and you will not expressly or by implication create the false or misleading impression that Tennis Warehouse is associated with, or endorses, or is in any way connected with you, your business, or your Content.

2. Prohibited Posts or Topics

Posts on the following topics violate this Policy and may result in removal of the post or thread, and suspending or banning the author:

1. Greatest of All Time (ie; ‘GOAT’) player threads: Due to the often contentious debate surrounding this topic, threads or posts devoted to this subject will be removed.
2. Doping allegations: Unsubstantiated claims will be deleted. Should a player be confirmed to have a doping incident, 1 thread on the subject will be allowed. Additional threads will be removed. Continued offenses may result in banning and/or blocking you from the Message Board. Subsequently if you have any concerns, please address them to the email id mentioned at the end of this Policy.
3. Politics/Religion: Threads or posts devoted to these subjects will be removed. Continued offenses may result in a warning in accordance with section 3 of this Policy.
4. COVID or health-specific discussions: Threads or posts devoted to this subject will be removed. Continued offenses may result in a warning in accordance with section 3 of this Policy, followed by banning and/or blocking you from the Message Board.
5. Inappropriate Nicknames of Players: Using offensive and negative names to describe a player (can be related to their appearance, age, personality, etc) will result in the post/thread being removed.
6. Negative Comments on Player's Appearance/Background/Private Life: Including but not limited to weight, hair, gender, sexual orientation, race and private life/relationships will be removed.
7. Excessive image/video posts/meme: A well-timed graphic can enhance a post, but excessive graphics can drown out the conversations and may be removed. Additionally, posting the same image/video/meme across threads is considered spamming.
8. Thread bumping: Bumping old threads only to troll another fan base or revive an old GOAT thread is not allowed, and those posts will be removed.
9. Questioning Moderation: Posted Content that is questioning, flaming or trolling moderation will be removed. Please send an email to discussadmin@tennis-warehouse.com if you would like to discuss why something was removed and we are happy to look into it further.
10. Junior Players: We do not allow the discussion of any specific junior players, unless they are pro players. Such Posted Content will be removed.
11. Previously Deleted Posts/Threads: Please do not repost a thread or post that has been removed. Reposts will automatically be removed even if there is a slightly different title, etc. Please reach out to a moderator if you believe there was an error in the removal.

3. Warning/Ban System

In the event you do not follow the rules set out in this Policy, you will be subjected to warnings, with a potential ban, in the following manner:

1. 1st warning - Post removed and email sent with reason why.
2. 2nd warning - Post removed and email sent with reason why and warning of potential ban.
3. 3rd warning - Post removed and 1 week ban.
4. 4th warning - Post removed and 1 month ban.
5. 5th warning - Post removed and permanent ban instituted.

Each warning is worth 1 point and does not expire. If there is Posted Content that the moderators feel is excessive, 2 or more points may be given. There is no set expiration date for previous warnings, but we will take any gaps between warnings into account before issuing any bans.

Please check your settings to make sure you are allowing emails/messages. Tennis Warehouse does not assume any responsibility or liability in the event you are not notified or aware of emails and/or messages containing the requisite warning.

4. Moderator Authority

Tennis Warehouse will appoint moderators to oversee discussions, enforce the Policy, and maintain a safe and respectful community environment. Moderators have the authority to:

1. Monitor Content: Review, edit, move, or remove any user-generated content that, in their sole discretion, violates the Policy or is otherwise inappropriate.
2. Issue Warnings: Provide users with warnings regarding content violations or inappropriate behavior as set out in Section 3.
3. Suspend or Ban Users: Temporarily or permanently restrict access to the Message Board for users who repeatedly violate the Policy or engage in misconduct.
4. Close or Lock Discussions: Lock, restrict, or close message threads that become disruptive, violate the Policy, or are deemed inappropriate.
5. Escalate Serious Violations: Report serious violations to the forum administrators, legal authorities, or other relevant parties as necessary.

Moderators act in their capacity as representatives of Tennis Warehouse but do not provide legal, professional, or official guidance. Decisions made by moderators are final and may not be appealed unless otherwise determined by Tennis Warehouse at its sole discretion.

Tennis Warehouse reserves the right to modify moderator powers, remove moderators, or amend moderation policies at any time without notice.
